During the period from march 2003 to march 2006 the petitioner was putting up in house no.403, bapuji nagar, thiruvananthapuram-XI, PIN 695011.

On the night of february 14, 2006, a criminal, along with an accomplice, broke into the petitioner's rented house, threatened him and showered vulgar abuses on him. A fist fight was avoided by the petitioner keeping his cool in spite of the acute provocation, and refusing to respond to the taunts of the assailant. the culprits walked out after about half an hour as there was no retaliation from the petitioner.

The above assault was completely unilateral; the petitioner had no share in the altercation and was just a spectator. However the petitioner did make an effort to film the incident using his newly acquired entry level digital camera but had only limited success due to technical problems and it being night time. A compact disk containing a picture of the above assailant and a voice record of the assailant issuing death threat to the petitioner is produced here with and marked EXHIBIT P.1

The petitioner is aware that the assailant is the resident of house No.BN 400, bapuji nagar, thiruvananthapuram PIN 695011, the second house on the opposite side of the road in front of the petitioner's then residence BN403.

The petitioner never had any dealings of any sort, verbal or otherwise, what so ever with this assailant. In fact, the first ever interaction between the petitioner and this "neighbour" of his for almost three years, was on that fateful night.

There was no reason what so ever, for the above assailant, who, as far as the petitioner is concerned is a perfect stranger, to take umbrage on the petitioner; nor would the assailant and his accomplices have dared to commit such a crime but for the peculiar circumstances of the petitioner's existence.

An ex-service officer, and a service pensioner of the kerala government, the petitioner has no criminal record whatsoever and never had any brushes with the law of the land.

All the same, the petitioner has been at the receiving end of the covert criminal activities of a gang of plain clothes men from the spy net works of the indian police for decades now. The petitioner understands that it is a policeman who calls himself CBI "officer" who is spearheading these criminal activities with the connivance of his stooges from other spy net works of the government, like the "special" branch of the the local police.

The above gang of police men, obviously aware of the criminal nature of their activities, have all through been in hiding and carrying on their nefarious activities by proxy through the obliging members of the local population drawn from all strata of society - from the petty criminals of the backstreets of Thiruvananthapuram city to senior members of officialdom and professional classes who are more than ready to do the bidding of the policemen.

Every one of the basic fundamental rights of the petitioner guaranteed by the indian constitution are being trampled upon with impunity by the spy net works of the indian police, abusing their tremendous clout with the officialdom. the petitioner's life is being made impossible by the covert criminal activities of the above gang of goons from the indian police.

The petitioner respects the law and not the whims of the policeman however mighty and influential. All through, he has stood up to the spy net works of the indian police. Out of desperation the policemen have been letting loose their hired thugs on the petitioner in an effort to terrorise the petitioner and make him submit to their dictates.

The criminal trespass on that eventful night in february 2006 in the bapuji nagar residence of the petitioner was only one of a series of such efforts on the part of the spy net works of the indian police in the recent past. The petitioner has firm reason to believe that the above assailant was acting on behalf of and on specific instructions from a senior member of the spy net work of the indian police who was parking himself in the assailant's house during the nights and directing his nefarious activities targeted at his innocent victim from there.

Another incident on an earlier occasion in may 2005 corroborates the petitioner's contention in this regard. On the night of 16/17 may 2005 two men claiming to be policemen from the Thiruvananthapuram medical college police station had knocked at the gate of the petitioner at 0300hrs for no reason whatsoever and had an argument with him. Half way through the incident, the policemen went towards the house BN 400 and the petitioner could see them talking to some one within the compound of the above house. The policemen then came back to abuse the petitioner before disappearing into the night. The petitioner believes that the policemen were taking orders from a senior member of the spy net work of the indian police who was present in the house BN400 at that odd hour.

incidents of a similar nature have taken place twice in the recent past in the various houses in which the petitioner has been putting up in thiruvananthapuram. The assailants in all the above cases, including the one from house no. BN 400, as far as the petitioner's information goes, were not regular offenders but people who want to get noticed and are coming up on being assured safe passage by the spies of the indian police.

The petitioner is convinced that the above incidents were the result of calculated moves made by the members of the spy networks of the indian police, engineered to create fright and make the petitioner submit to the demands of the policemen - the death threat to the petitioner in fact, was being delivered by the members of the spy net work of the indian police.

POSTSCRIPT

it was a no win situation for me. if i take on the culprit i will get implicated in a criminal case. then the police man can walk into my place openly on the pretext of making an enquiry (rather than on the sly as is being done now). also, in the resulting melee all attention will be deviated from the indian gestapo, the actual perpetrator of the crime. and the gestapo will get away with all the criminal activities carried out by them till date.

even if i succeed in eliminating this particular goon, it is not going to change the situation a wee bit - the spy net work has their informers who i understand get paid handsomely from unaudited government funds. and another of their rabid dogs will be let loose on me.

the only way open to me was to pocket the insult, at least for the time being, and that is exactly what i did.

when two men with better physique than you come to your house and threaten to beat you to death, wont you be shit scared? well, some how or other i did not panic.

in fact i, as i said earlier, was indeed making an effort to film the scene; but the result of that effort was not very satisfactory. in fact nothing came out till the goons walked out, and it is only then that the cam started working.

this sort of thing has happened time and again: at critical moments the cam will shut down on one pretext or other. it is an electronic gadget and it can be tweaked and i can assure you, my house was being broken into by the gestapo, of course for "security" reasons. there is no point elaborating on it over here.

incidentally, are you aware that in california they have given up electronic voting machines (while in india they are still continuing to use it) ? there was a sub-editorial in nature some time back on it and i made a photo copy of it and handed it over to the staff of the electoral officer of kerala state in the legislature complex in this city (this particular office is close to that of the lok aayukta where i filed a petition and got my gratuity amount released) the intellectual in that office was amused and was putting his left hand to his head (as per the directions of the indian gestapo); to him it was another evidence of my insanity! most people here live in "paradise" - that proverbial one.

well, coming back to the trespass: is this sort of thing a normal phenomenon in civilized societies? some one breaks into another's private residence and delivers death threats and goes scot-free? or is this a situation peculiar to the largest "democracy" in the world?

now look at another aspect of it. i am in my late fiftees; even otherwise i am not famous for my physical prowess. thanks to the spade work done by the indian police i am living the life of a complete loner and so no body is going to come to my help in any way in any matter. i do not blame them; they are being sensible - who would want to fight the indian gestapo?
the principle is "veleemmal kitakkunna pambine etuth konan kettathirikkuka" - let the snake basking in the sun lying on the fence, be; dont try to pick it up, leave alone use it as your "konan" ( the traditional loin cloth used all over india - the G-string will be the closest approximation in the white man's lingo). in short do not try to pick up the snake from the fence and use it as your g-string; leave it alone and let it enjoy itself as long as it is not trying to harm you.

so whatever is to be done i will have to do on my own. how would i go about it now that this sort of phenomenon has become a common feature of my life - thanks to the indian gestapo? i have thought about it.

on my own i will not be able to take a second blow from an attacker; i dont have any practical experience on the matter and it is just a conjecture, i mean my theoretical assumption. so i will have to stun the fellow with one blow.

now it is not that you are giving an anaesthetic that you calibrate the dose and see that the fellow is put to sleep and is not killed. there is a possibility that i unintentionally used more than the required force ( i cannot afford to err on the other side for obvious reasons) and some thing drastic might happen. And i dont want that to happen.

i do not act on rash momentary inspirations. if i do something it is only after giving due consideration to the matter examining all the pros and cones: expect the best and prepare for the worst. by the way, desperate situations mostly require desperate remedies and my situation is desperate.

the situation has not changed at all; and if at all it has changed, it is for the worst. the indian gestapo is prowling in the vicinity of my present house as well and the atmosphere is tense. the trivandrumites in the neighbourhood are thrilled that they could play host to the "eemans" ( the masters) from the police. the gestapo has to save his face and in desperation is bound to produce another goon or a number of goons from this locality any time now.

i am an ordinary mortal. i am not a follower of jesus christ or even m.k. gandhi for that matter. there is a limit to ones patience. pushed to the corner i will have to retaliate. i want to avoid such a situation. i neither want to become a criminal nor a murderer for that matter. but that is exactly what the india gestapo is aiming at. come whatever may and at any cost, the wretch wants to get a hold on me!


and that is why as a last resort i am making an effort to get my side heard by the apex court. nothing positive is expected; but there is no harm trying. i am on the job
